Terms of Service

These Terms of Service ("Terms") govern your access to and use of The Bet Pool website, content and subscription services (the "Service"). By creating an account, subscribing, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Acceptance of Terms

By accessing or using the Service you confirm that you have read, understood and agree to these Terms and our Privacy Policy, Refund Policy, Cookie Policy and Community Guidelines, which are incorporated by reference. These Terms form a binding agreement between you and The Bet Pool ("we", "us", "our").

2. Eligibility

You must be at least 18 years of age and legally permitted to access sports betting information in your jurisdiction to use the Service. By using the Service you represent and warrant that you meet these requirements. The Service is intended for residents of Australia; you are responsible for ensuring your use complies with the laws that apply to you.

To access certain features you must create an account and provide accurate, current information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@thebetpool.com if you suspect unauthorised use. One account is for one individual only.

5. Subscription & Billing

Access to premium features is provided on a paid subscription basis. Prices are displayed at the point of purchase and are inclusive of applicable taxes unless stated otherwise. Payments are processed securely by our third-party payment provider (Stripe); we do not store your full card details. Where a free trial is offered, you will not be charged during the trial period, and billing begins automatically when the trial ends unless you cancel beforehand.

You may cancel at any time. Cancelling stops future renewals; your access continues until the end of the current paid billing period, after which it will not renew. You can cancel by contacting support@thebetpool.com or through any self-service option we provide. It is your responsibility to cancel before a renewal date if you do not wish to be charged for the next cycle.

8. Refunds

Refunds are handled in accordance with our Refund Policy and your rights under the Australian Consumer Law. Because cancelling prevents future charges, we generally do not provide refunds for a billing period that has already begun, except where required by law.

9. Acceptable Use

You agree not to: use the Service for any unlawful purpose; share, resell or provide access to your account; scrape, copy, or redistribute our content without permission; attempt to gain unauthorised access to our systems; interfere with or disrupt the Service; or engage in conduct that violates our Community Guidelines. We may investigate and take action against any suspected misuse.

10. Intellectual Property

All content, branding, logos, data compilations, models, software and materials on the Service are owned by or licensed to The Bet Pool and are protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to access the Service for your own personal, non-commercial use. You may not reproduce, distribute or create derivative works without our prior written consent.

11. User-Generated Content

If you post messages, comments or other content (including within our community channels), you retain ownership of it but grant us a worldwide, royalty-free licence to host, display and use it to operate the Service. You are solely responsible for content you submit, and you must not post anything unlawful, misleading, infringing or in breach of our Community Guidelines. We may remove content at our discretion.

12. Account Suspension & Termination

We may suspend or terminate your account, with or without notice, if you breach these Terms, misuse the Service, or where required to protect the Service or other users. You may stop using the Service at any time. Provisions that by their nature should survive termination (including intellectual property, disclaimers and limitation of liability) will continue to apply.

13. Disclaimers

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that any information will be accurate or complete. Nothing in these Terms excludes rights or guarantees that cannot lawfully be excluded, including under the Australian Consumer Law.

14. Limitation of Liability

To the maximum extent permitted by law, The Bet Pool and its officers, employees and partners will not be liable for any indirect, incidental, special or consequential loss, or for any loss of profits, winnings, revenue, data or opportunity, arising from your use of the Service. Where our liability cannot be excluded, it is limited (at our option) to resupplying the Service or paying the cost of having it resupplied, or to the amount you paid us in the 12 months before the claim.

15. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use and protect your personal information.

16. Governing Law

These Terms are governed by the laws of Australia and the State of New South Wales. You submit to the non-exclusive jurisdiction of the courts of that state and the Commonwealth of Australia. Your statutory rights as a consumer are not affected.

17. Changes to These Terms

We may update these Terms from time to time. When we make material changes we will update the "Last updated" date and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
